The FIA International Court of Appeal met on 3 September to consider an appeal made by Ferrari AF Corse following the 6 Hours of Spa Francorchamps in May.
The appeal was rejected and the published final Race Classification will stand with the #12 Hertz team Jota Porsche confirmed as the winner.
The issue arose after a Stewards decision 105_Doc 105 – Decision No. 71 to restart the race for 1 hour and 40 minutes after a lengthy Red Flag for Earl Bamber’s monster crash on the Kemmel Straight.
That decision was later appealed by Ferrari AF Corse to the Stewards who rejected the appeal.
Ferrari AF Corse then chose to appeal that decision and, “consequently” against the published Provisional race classification which saw the #12 Hertz Team Jota Porsche take the win after the previously race-leading Ferrari, and much of the remainder of the Hypercar field, were forced to pit for fuel when the restarted race went back to Green Flag running, the #12 having done so just before the Red Flag halted proceedings.
In a judgement published today the appeal was rejected, principally on the procedural grounds that a Stewards Decision cannot be the subject of a protest under article 13.2.1 of [the] FIA International Sporting Code”.
