BHOPAL: Refusing physical relations to a husband amounts to cruelty under Hindu Marriage Act, Madhya Pradesh HC said, while upholding a family court’s decision to grant divorce to the husband on this ground.
HC gave this verdict for a couple that got married on May 26, 2013. It observed that denial of physical intimacy to a husband amounts to cruelty.Just 3 days after marriage, the woman’s brother took her to her parental home for her to take some exam. When her in-laws went to bring her back a few days later, she refused to come with them.
The woman then lodged a complaint of dowry harassment against her in-laws in Sidhi. The couple then agreed to divorce by mutual agreement. The wife, however, lodged a complaint of domestic violence against her husband, who filed for divorce in Satna family court under provisions of Hindu Marriage Act. After hearing both sides, the family court granted divorce on Aug 17, 2021.
The woman challenged the divorce decree in HC. During hearing, the husband said his wife stayed with him for just three days and they didn’t have physical relationship during the period.
